PREMIER DRIVING SCHOOL, INC. TERMS AND CONDITIONS

Welcome to Premier Driving School Inc. (referred to as “we”, “our”, “us”, or “Premier”). We are licensed by the Maryland Motor Vehicle Administration (MVA) to provide driver education and related services to new drivers, licensed drivers, and instructor candidates in Maryland. We offer driver education courses, both classroom and in-car lessons, to new drivers; remedial training to experienced drivers; and instructor training for Premier and other schools.
By enrolling in our programs, accessing our website and services, you (the “Student”, “you”, or “your”) agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully. Enrollment or use constitutes acceptance. If you are under 18, your parent/guardian must review and consent (see Section 17). These Terms comply with Maryland law, including COMAR Title 11, Subtitle 23, Chapter 02, and may be updated; check our website for changes.
1. Services and Products
Our services include driver education programs (30 hours classroom + 6 hours behind-the-wheel for standard courses), remedial training, and instructor certification training. All are subject to availability and may be modified, discontinued, or canceled by us without notice for operational reasons (e.g., low enrollment or instructor availability). We reserve the right to refuse service if eligibility is not met.
2. Eligibility and Enrollment
To enroll:
- You must be seeking a noncommercial driver’s license and meet Maryland age requirements (e.g., at least 15 years to start classroom, at least 15 years and 9 months for behind-the-wheel).
- Provide accurate, current, and complete information, including ID, contact details, and any medical/psychological conditions that could affect driving safety.
- For behind-the-wheel instruction: Present a valid Maryland learner’s permit before scheduling and before each lesson.
- For minors: Obtain parent/guardian consent (see Section 17).
- All enrollments are non-transferable without our written approval.
3. Student Responsibilities
You agree to:
- Provide accurate and complete information and update us of any changes.
- Maintain confidentiality of any account credentials (if applicable).
- Comply with all federal, state, and local laws, including Maryland traffic laws and MVA guidelines.
- Disclose any impairments, medications, or conditions affecting driving; failure may result in removal from the program.
- Attend all sessions on time, prepared, and without distractions (e.g., cell phones off).
- Student’s full face must be visible on camera for virtual classroom sessions.
- Student must be in an environment conducive to learning for virtual classroom session (e.g., not at work, not in a moving vehicle with other passengers).
- Respect instructors, staff, and peers; no disruptive behavior.
4. Payment and Billing
We offer paid and free services. Paid services require full upfront payment at registration, online or in-person. We accept major credit cards, cash, checks, or money orders.
- Prices are listed on our website and subject to change.
- Returned checks incur a $25 fee; customer-initiated chargebacks incur a $25 fee.
- Failure to pay may lead to suspension or cancellation of services, with additional collection fees.
- For online payments, we use secure processors; you are responsible for transaction security.
5. Refunds and Returns
Refunds are processed within 7-10 business days via original method.
Our Driver Education Program includes both classroom (in-person or virtual) and behind-the-wheel (in-person) instruction. Refunds are available as follows:
- Full Refund: You may receive a full refund for any part of the program if you cancel before the start of the classroom course (in-person or virtual) or any behind-the-wheel lesson.
- No Refund: No refunds will be issued for any portion of the program that has already been completed.
- No refunds for additional fees like no-show ($50).
- No refunds for instructor training or remedial courses.
6. Cancellation, Rescheduling, and No-Show Policies
- Cancellations: You must provide at least 24 hours’ notice for behind-the-wheel; less than 24 hours notice will be considered a no show and charged the current no show fee.
- No-shows: Charged $50; repeated No-show may lead to termination.
- We may cancel for safety (e.g., weather)and will reschedule at no charge within a reasonable time.
- Extensions beyond 18 weeks: Available upon request.
7. Privacy and Data Collection
We respect your privacy and comply with the Maryland Personal Information Protection Act. By using our services, you consent to our Privacy Policy, which details how we collect, use, share, and protect data (e.g., completion info shared with MVA for certification). We notify of breaches per law.
8. Intellectual Property
All website content (text, graphics, logos, etc.) is owned by Premier or licensors, protected by federal law. You may not reproduce or distribute without permission.
9. Limitation of Liability and Assumption of Risk
Driving involves inherent risks (e.g., accidents, property damage). You assume these risks and release us from liability for injuries, or damages unless due to our gross negligence. We are not liable for indirect,consequential, or punitive damages. Our total liability to you for any claim limited to amounts paid for our services. We offer no guarantee of MVA license passage.
10. Indemnification
You indemnify and hold harmless Premier, its staff, and agents from any and all claims arising from your breach of Terms, your negligence during lessons, or your violations of law, including any and all legal fees and costs we incur.
11. Governing Law
This agreement for our services is overned by Maryland law; any and all disputes arising under these Terms or our services shall be resolved in Harford County courts.
12. Changes to Terms
We may update these Terms and changes will be posted with the new effective date. Continued use constitutes acceptance.

14. Driver Education Requirements
- Eligibility: Must be seeking a noncommercial license; must present a learner’s permit for behind-the-wheel training.
- Classroom: 30 hours (maximum 3 hrs./day), you may miss ≤12 hours with make-ups; must attain a score of 80% on the final exam.
- Behind-the-Wheel: 6 hours (maximum 2 hrs./day), attain a score of 80% on the final evaluation; and complete within 18 weeks (extendable).
- Completion: Attend/participate fully, pass exams; remedial fees may apply.
- Discontinuation: Your training may be discontinued for lateness, excessive absences, or disruption; we will notify you and document.
- Make-Ups: Classes are available for missed classroom sessions.
15. Safety and Conduct During Lessons
- Vehicles: All instructional vehicles are maintained per MVA requirements, with dual controls; no personal items are allowed in the vehicles.
- Conduct: You must wear appropriate attire/footwear; no substances of any kind, no food or drink, distractions, or unsafe actions.
- We may end sessions early for safety.
16. Force Majeure
We are not liable for delays due to events beyond our control (e.g., weather, disasters); services will be rescheduled.
17. Parent/Guardian Consent for Minors
For students under 18, parent/guardian must sign a consent acknowledging risks and responsibilities. They may attend sessions.
18. SMS Communications
By providing your mobile phone number during enrollment or registration, you expressly consent to receive transactional text (SMS/MMS) messages from Premier Driving School Inc. related to your services, such as appointment reminders, scheduling confirmations, or course updates. These messages are sent using an automatic telephone dialing system (ATDS) or other automated technology, in compliance with the Telephone Consumer Protection Act (TCPA) and other applicable federal and state laws.
We will not use your phone number for marketing or promotional purposes, nor will we share, sell, or rent it to third parties without your explicit consent, except as required by law (e.g., for MVA reporting).
Standard message and data rates may apply, depending on your mobile carrier and plan. Message frequency will vary based on your scheduled services but is typically limited to essential notifications.
To opt out of receiving SMS messages at any time, reply “STOP” to any message from us. Upon receiving your opt-out request, we will send a single confirmatory message (within five minutes) acknowledging your request and will cease sending further messages. You may also contact us at service@premierdriversed.com or 410-877-7100 to manage your preferences. Opting out of SMS will not affect your enrollment or other communications (e.g., email or phone calls), but it may impact your ability to receive timely reminders.

19. Miscellaneous
- Severability: Should any provision of this Terms be found, or deemed to be unenforceable, voidable or void, as contrary to law or public policy under the laws of the State of Maryland or any federal law, the remaining provisions shall nevertheless continue in full force and be binding upon you.
- Entire Agreement: These Terms contain the entire understanding between you and us. No modification or waiver of any of the Terms shall be valid unless made in writing and signed by us. There are no representations, terms, conditions, statements, promises or understandings oral or written, other than those expressly set forth herein.
- Electronic Signatures: You agree that an electronic signature, whether digital or encrypted, is intended to have the same force and effect as a manual signature, (ii) you intend to be bound by your electronic signatures, and (iii) hereby waive any defenses to the enforcement of the Terms based on the foregoing forms of signature.
